There are numerous legal terms used every day in real estate, business, and civil litigation matters. This glossary covers some of the more common ones you may encounter, with practical definitions to help you understand what they mean.
Adverse Possession
A way of acquiring ownership of property by using it openly, continuously, and without permission for a legally required period of time. If all legal requirements are met, the person in possession may claim title to the property.
Affirmative Defense
A defense raised by a defendant that, even if the plaintiff’s claims are true, provides a legal reason why the defendant should not be held liable (for example, statute of limitations or waiver).
Answer
The defendant’s formal response to a lawsuit. It addresses the allegations made in the petition and may include defenses. Failing to file an answer on time can result in a default judgment.
Citation
The official notice issued by the court that a lawsuit has been filed. It is served with the petition and informs the defendant of the case and the deadline to respond.
Contract
A legally enforceable agreement between two or more parties that creates obligations. Contracts may be written or, in some cases, oral, depending on the subject matter.
Default Judgment
A judgment entered against a party who fails to respond to a lawsuit or appear in court. It allows the other side to obtain relief without a full trial.
Easement
A right to use someone else’s property for a specific purpose, such as access, utilities, or drainage, without owning the property itself.
Guaranty (Guarantee)
A promise by an individual to be personally responsible for a business debt or obligation if the business fails to pay. This is commonly required in business loans or leases.
Indemnification
A contractual obligation where one party agrees to cover losses, damages, or liabilities incurred by another party under certain circumstances.
Lien
A legal claim against property used to secure payment of a debt or obligation. If the debt is not paid, the lienholder may have rights to enforce the claim against the property.
Local Rule
Rules adopted by a specific court or county that govern how cases are handled in that court, in addition to statewide rules like the Texas Rules of Civil Procedure.
Petition
The document that starts a lawsuit. It is filed by the plaintiff and sets out the claims, facts, and relief being requested from the court.

The set of rules that govern how civil lawsuits are handled in Texas courts, including procedures for filing, discovery, motions, and trial.
