Ownership & Property Rights

Property rights are so important in Texas that there is longstanding principle reflected in our Constitution that life, liberty, and property are to be given significant legal protection. The right to own, use, and transfer property is central to our society and these rights can extend beyond the surface to include mineral interests and even air rights.

These rights are often defined through documents such as deeds, easements, leases and other agreements. In many situations, multiple interests may exist at the same time, with different parties holding different rights in the same property. Understanding how those rights fit together is often necessary to determine what can—and cannot—be done with a property.

Issues involving ownership and property rights can arise in a variety of contexts, including transactions, neighboring property disputes, or disagreements among parties with an interest in the same property. These matters often require review of recorded documents, surveys, and the history of the property to identify the scope of the rights involved.

Because property rights directly affect the use, value, and transfer of real estate, they are often at the center of both transactional real estate matters and disputes.

Transactional

Real estate transactions involve the creation, transfer, and definition of property rights through a wide range of agreements. These can include straightforward matters such as preparing or reviewing a deed, as well as more involved arrangements like seller financing transactions, reciprocal access easements, licenses, and other property-related contracts.

Even relatively simple transactions can have lasting effects depending on how the documents are structured and recorded. Issues such as access, use rights, payment terms, and future obligations are often addressed at this stage, and the way they are handled can impact the property long after the transaction is complete.

While many transactions proceed without issue, disputes can arise when agreements are unclear, incomplete, or not carried out as intended. In those situations, the documents created during the transaction often become central to resolving the matter

Disputes

Disputes can arise in a variety of real estate contexts, including issues related to ownership, the use of property, and the performance of agreements. These may involve breach of contract in a transaction, disagreements over access or use rights, or competing claims to ownership or interests in the same property.

In many cases, these disputes center on how property rights were defined—or not clearly defined—in the underlying documents. Resolving these issues often requires careful review of agreements, recorded instruments, and the history of the property to determine the scope of the rights involved.

Depending on the circumstances, disputes may be addressed through negotiation, alternative dispute resolution such as mediation or arbitration, or through litigation when necessary. The appropriate approach will often depend on the nature of the dispute and the objectives of the parties involved.
